________________________________________
1. PURPOSE OF THE PLAN
The Property Repair Subscription Plan (“Plan”) is a subscription-based property repair protection service designed to provide eligible property owners with access to repair services for qualifying critical incidents affecting their property during the applicable subscription period.
The Plan is intended to provide protection against significant repair requirements involving specialist expertise, specialist equipment and/or heavy machinery.
The Plan is not intended to cover ordinary property maintenance, routine wear and tear, minor repairs, cosmetic defects or general property upkeep.
This Policy sets out the terms, conditions, limitations, exclusions and procedures applicable to the Plan.
________________________________________
2. DEFINITIONS
For purposes of this Policy, the following terms shall have the meanings set out below:
2.1 “Provider”
Means [COMPANY NAME], including its employees, appointed contractors, specialists, agents and authorized representatives.
2.2 “Subscriber”
Means the person who subscribes to the Plan and who is a legal or registered owner or co-owner of the Covered Property.
2.3 “Covered Property”
Means the residential property registered with and accepted by the Provider under the Plan.
2.4 “Subscription Fee”
Means the fee paid by the Subscriber for the applicable Plan and subscription period.
2.5 “Waiting Period”
Means the initial ninety (90) calendar day period commencing from the Effective Date during which no service claim may be made or accepted.
2.6 “Claimable Event”
Means a critical property incident that satisfies the eligibility requirements of this Policy and is determined by the Provider to qualify for service under the Plan.
2.7 “Repair Cost”
Means the cost of approved repair work directly relating to a Claimable Event, excluding inspection, assessment, diagnostic and other expressly excluded costs.
2.8 “Service Limit”
Means the maximum value of repair services available under the Plan, calculated as ten (10) times the Subscription Fee actually paid for the applicable subscription period.
2.9 “Completion Sign-Off”
Means the written, electronic or otherwise documented confirmation by the Subscriber that the approved repair work has been completed.
________________________________________
3. WHO CAN SUBSCRIBE
The Plan is available only to a legal or registered owner or co-owner of the Covered Property.
The Subscriber must be one of the legal or registered owners of the property at the time of subscription.
Where a property has multiple owners, any one of the registered owners may subscribe to the Plan, subject to acceptance by the Provider.
The Provider may require reasonable evidence of ownership, including but not limited to a title deed or land title, a sale and purchase agreement, property ownership records, assessment records, quit rent records, government-issued property documentation, or other documents reasonably acceptable to the Provider.
A person who is merely a tenant, occupant, property agent, property manager, contractor, family member of the owner, authorized representative, or other non-owner is not eligible to subscribe in their own name unless expressly approved by the Provider and permitted under the applicable terms.
The Provider reserves the right to reject a subscription where the Subscriber cannot satisfactorily demonstrate ownership or co-ownership of the Covered Property.
________________________________________
4. PROPERTY ELIGIBILITY
The Covered Property must be accepted by the Provider at the time of subscription.
Unless otherwise agreed in writing, the Plan applies only to an occupied residential property.
The following properties are not eligible: properties under construction; properties undergoing major construction or reconstruction; properties that have not been completed or handed over for occupation; commercial properties; industrial properties; offices; shops or retail premises; warehouses; agricultural properties; other non-residential properties; vacant or unoccupied properties; properties where the Subscriber is not an owner or co-owner; or any property otherwise rejected by the Provider.
The Provider may require an initial inspection or supporting documentation before accepting a property into the Plan.
________________________________________
5. SUBSCRIPTION
The Plan becomes effective when the Provider accepts the subscription, the required information has been provided, the Covered Property has been accepted, and the applicable Subscription Fee has been received.
The Effective Date shall be the date specified in the subscription confirmation issued by the Provider.
The Subscriber must maintain an active subscription in accordance with the applicable subscription terms.
________________________________________
6. 90-DAY WAITING PERIOD
A ninety (90) calendar day waiting period applies from the Effective Date.
No Claimable Event may be claimed or accepted during the first ninety (90) calendar days.
Any defect, damage, incident or repair requirement that occurs during the Waiting Period, first becomes apparent during the Waiting Period, existed before the Effective Date, or is reasonably determined to have existed before expiry of the Waiting Period, shall not become claimable merely because the Waiting Period subsequently expires.
The Provider may require photographs, documents, inspection reports or other evidence to determine when an incident occurred or became apparent.
________________________________________
7. CLAIM FREQUENCY
Subject to this Policy, the Subscriber is entitled to a maximum of one (1) Claimable Event every twelve (12) months.
The applicable twelve-month period shall be calculated from the Subscription Effective Date or renewal date, as determined by the Provider.
Unused claim entitlement does not accumulate or carry forward.
Multiple incidents occurring during the same twelve-month period do not create multiple claim entitlements.
Where multiple defects arise from one incident, the Provider may treat them as one Claimable Event.
________________________________________
8. SCOPE OF PROTECTION
The Plan covers the approved Repair Cost only for an accepted Claimable Event.
A Claimable Event generally must involve a critical or significant property repair issue, require specialist expertise, specialist equipment and/or heavy machinery, and fall within the intended service scope of the Plan.
Examples of potentially qualifying works may include significant repair works requiring specialist contractors, specialist engineering expertise, heavy machinery, specialized equipment, substantial structural repair resources, or other specialized repair capabilities.
The above examples are illustrative only.
The existence of specialist involvement or heavy machinery does not automatically make an incident claimable.
The Provider shall determine whether an incident qualifies as a Claimable Event.
________________________________________
9. REPAIR COST ONLY
The Plan provides protection for approved repair costs only.
The Plan does not automatically cover inspection, diagnosis, assessment, investigation, professional consultation, testing, reports, transportation, temporary accommodation, loss of use, consequential losses, loss of rental income, loss of business, personal expenses, legal expenses, or other costs not directly forming part of the approved repair.
Unless expressly agreed otherwise, these costs shall remain the responsibility of the Subscriber.
________________________________________
10. INSPECTION AND ASSESSMENT COST
An inspection may be required before the Provider determines whether an incident is claimable.
Inspection and assessment costs are excluded from the Plan.
The Subscriber shall be responsible for applicable inspection fees, diagnostic fees, assessment fees, testing fees, professional assessment fees, and related investigation costs.
Payment of an inspection fee does not guarantee approval of a claim.
The Provider may require payment of the applicable inspection or assessment fee before arranging an inspection.
________________________________________
11. SERVICE LIMIT
The maximum service value available under the Plan shall be 10 × the Subscription Fee actually paid by the Subscriber.
For example, if the Subscription Fee is RM1,000, the Maximum Service Limit is RM1,000 × 10 = RM10,000.
The Service Limit is the maximum amount the Provider is required to provide or incur for approved repair services during the applicable entitlement period.
The Provider shall not be required to incur costs exceeding the applicable Service Limit.
Where the approved Repair Cost exceeds the Service Limit, the Subscriber shall be responsible for the excess amount if the Subscriber elects to proceed with the repair.
________________________________________
12. CLAIM PROCEDURE
The Subscriber must notify the Provider as soon as reasonably practicable after becoming aware of a potential Claimable Event.
The Provider may require the Subscriber to provide photographs, videos, a description of the incident, the date the problem was first discovered, property information, ownership documentation, previous repair records, inspection reports, quotations, invoices, contractor information, and any other information reasonably required to assess the claim.
The Subscriber shall cooperate reasonably with the Provider during the claim assessment process.
Failure to provide reasonably requested information may result in the claim being delayed or declined.
________________________________________
13. INSPECTION
The Provider may arrange an inspection before determining whether a Claimable Event exists.
The inspection may be conducted by the Provider, the Provider's employees, appointed contractors, specialist contractors, engineers, technicians, or other qualified third parties.
The Subscriber shall provide reasonable access to the Covered Property for inspection.
The inspection date and time shall, where reasonably practicable, be mutually agreed between the Provider and Subscriber.
An inspection does not constitute approval of a claim.
________________________________________
14. CLAIM DETERMINATION
The Provider shall assess each claim based on information supplied by the Subscriber, inspection findings, photographs and videos, technical assessments, supporting documentation, property condition, the nature and cause of the incident, and other relevant circumstances.
The Provider shall have the final determination as to whether an incident constitutes a Claimable Event, subject to applicable law.
The Provider shall also determine the amount of eligible Repair Cost payable or provided under the Plan.
A quotation supplied by the Subscriber does not automatically establish the amount payable under the Plan.
The Provider may obtain its own quotation, appoint its own contractor or determine an alternative reasonable repair method.
________________________________________
15. DETERMINATION OF REPAIR COST
Where a claim is approved, the Provider may determine the eligible Repair Cost based on actual repair requirements, reasonable market rates, materials required, specialist labour, machinery requirements, contractor quotations, site conditions, technical requirements, and other relevant factors.
The Provider may approve only the portion of a quotation that directly relates to the approved repair.
The following are not included unless expressly approved: upgrades, enhancements, improvements, unrelated repairs, cosmetic improvements, additional works, or work outside the approved scope.
________________________________________
16. REPAIR SCHEDULE
Where a claim is approved, the inspection and repair schedule shall be mutually agreed between the Provider and Subscriber where reasonably practicable.
The scheduling process may take into account contractor availability, specialist availability, machinery availability, material availability, site conditions, safety requirements, weather, access restrictions, operational requirements, and other relevant circumstances.
Notwithstanding the foregoing, the Provider shall have the final determination regarding the repair schedule, taking into account reasonable operational and technical requirements.
The Provider shall not be responsible for delays caused by circumstances beyond its reasonable control.
________________________________________
17. SUBSCRIBER'S RIGHT NOT TO PROCEED
Approval of a claim does not require the Subscriber to proceed with the repair service offered by the Provider.
The Subscriber may elect not to proceed with the proposed repair.
If the Subscriber elects not to proceed, the Provider shall have no obligation to provide an alternative repair service, the Subscriber shall remain responsible for any inspection, assessment or other costs already incurred, the Provider shall not be responsible for subsequent deterioration or damage resulting from the Subscriber's decision not to proceed, and the claim shall be treated in accordance with the applicable terms of the Plan.
Unless otherwise agreed in writing, an approved service entitlement cannot be converted into cash.
________________________________________
18. PROVIDER-APPOINTED CONTRACTORS
The Provider may appoint contractors, specialists, engineers, technicians or other service providers to perform approved repair work.
The Provider may determine the appropriate contractor or specialist based on technical requirements, availability, qualifications, location, equipment requirements, cost, and other relevant factors.
The Subscriber shall provide reasonable access to the Covered Property to allow approved works to be performed.
________________________________________
19. NO CASH SETTLEMENT
The Plan is a service-based protection arrangement.
It does not provide an automatic entitlement to cash payment.
Unless expressly agreed otherwise in writing, the Subscriber shall not be entitled to cash settlement, cash reimbursement, payment in lieu of repair, reimbursement for independently arranged repairs, or payment of unused Service Limit.
The Provider may, at its discretion and subject to applicable law, agree to an alternative arrangement in writing.
________________________________________
20. INDEPENDENT REPAIR WORK
The Subscriber must not arrange independent repair work for a potential Claimable Event without first notifying the Provider where reasonably practicable.
Independent repair work undertaken without the Provider's prior approval may not be covered under the Plan.
Where emergency work is reasonably necessary to prevent immediate and significant further damage or to address an immediate safety concern, the Subscriber should notify the Provider as soon as reasonably practicable and retain relevant photographs, invoices, reports and other supporting documentation.
________________________________________
21. EXCLUSIONS — GENERAL
The following are excluded from the Plan unless expressly agreed otherwise in writing.
21.1 Day-to-Day Wear and Tear
The Plan does not cover normal deterioration, ageing or ordinary wear and tear.
Examples include ageing, deterioration, minor cracks, minor leaks, worn fittings, worn fixtures, routine plumbing maintenance, routine electrical maintenance, repainting, cleaning, servicing, and other routine maintenance.
21.2 Routine and Minor Repairs
Routine, minor or maintenance-related repairs are excluded.
21.3 Cosmetic Damage
Cosmetic damage that does not constitute a qualifying critical incident is excluded.
21.4 Pre-Existing Conditions
Defects or damage existing before the Effective Date or during the Waiting Period are excluded.
21.5 Property Under Construction
Properties under construction, development, renovation, reconstruction or completion are excluded unless expressly accepted by the Provider.

Commercial, industrial, office, retail, warehouse, agricultural and other non-residential properties are excluded unless expressly accepted in writing.
21.7 Vacant Property
Vacant or unoccupied properties are excluded.
21.8 Upgrades and Improvements
The Plan does not cover improvements or upgrades beyond restoring the affected property or component to a reasonable repair condition.
21.9 Unrelated Repairs
Repairs unrelated to the approved Claimable Event are excluded.
________________________________________
22. SUBSCRIBER RESPONSIBILITIES
The Subscriber is responsible for providing accurate information, proving ownership when requested, maintaining the property in a reasonably appropriate condition, notifying the Provider of potential claims promptly, providing reasonable access for inspection, providing reasonable access for approved repair work, paying applicable inspection and assessment costs, paying costs outside the approved scope, paying costs exceeding the Service Limit, notifying the Provider of material changes to the property, and complying with reasonable instructions relating to approved repairs.
________________________________________
23. POST-REPAIR WARRANTY
23.1 Seven-Day Warranty
For an approved repair carried out by the Provider or its appointed contractor under the Plan, a seven (7) calendar day post-repair warranty shall apply.
The warranty period begins on the date the Subscriber signs the Completion Sign-Off.
23.2 Warranty Scope
The warranty applies only to a defect or failure that directly relates to the approved repair work, occurs or becomes apparent within the seven-day warranty period, and is reasonably determined by the Provider to have resulted from defective workmanship or failure of the completed repair work.
Any warranty rectification shall be limited to the original approved repair scope.
23.3 Warranty Exclusions
The post-repair warranty does not cover new or unrelated defects, defects outside the original repair scope, normal wear and tear, misuse, negligence, intentional damage, damage caused by the Subscriber, damage caused by third parties, subsequent renovation, subsequent modification, subsequent independent repair, external events, natural disasters, underlying structural conditions not included in the original repair, upgrades, improvements, or additional works requested by the Subscriber.
23.4 Warranty Notification
The Subscriber must notify the Provider as soon as reasonably practicable after discovering a potential warranty issue.
The Provider may require photographs, videos, inspection, testing, technical assessment, or other supporting information.
23.5 Warranty Determination
The Provider shall determine whether a reported issue is related to the completed repair and whether it falls within the seven-day warranty.
Where the issue is determined to be covered, the Provider may arrange reasonable rectification of the affected repair.
________________________________________
24. COMPLETION SIGN-OFF
Upon completion of an approved repair, the Subscriber shall be given an opportunity to inspect the completed work.
The Subscriber shall sign the Completion Sign-Off confirming completion of the approved repair.
The Completion Sign-Off shall record the property address, claim reference, description of repair, repair completion date, Subscriber's confirmation, warranty commencement date, and warranty expiry date.
The seven (7) calendar day warranty begins from the Completion Sign-Off date.
Where the Subscriber refuses or fails to sign the Completion Sign-Off after being given a reasonable opportunity to inspect the completed repair, the Provider may record the actual completion date as the commencement date of the seven-day warranty period, subject to applicable law.
________________________________________
25. CHANGES IN PROPERTY OWNERSHIP
The Subscriber must notify the Provider if ownership of the Covered Property changes during the subscription period.
This includes sale, transfer of ownership, transfer of the Subscriber's ownership interest, inheritance, disposal of ownership, or any other event causing the Subscriber to cease being an owner or co-owner.
If the Subscriber ceases to be an owner or co-owner, the Plan may be terminated in accordance with the applicable subscription terms.
The Plan does not automatically transfer to a new owner.
A new owner may be required to submit a new subscription application and satisfy all applicable eligibility requirements, including the applicable Waiting Period.
________________________________________
26. MISREPRESENTATION AND FRAUD
The Provider may decline a claim where the Subscriber provides materially false information, conceals relevant information, misrepresents the condition of the property, deliberately causes damage, submits a fraudulent claim, alters evidence, submits false documents, or otherwise abuses the Plan.
The Provider may suspend or terminate the Plan in cases involving fraud or material misconduct, subject to applicable law.
________________________________________
27. PROPERTY MAINTENANCE
The Plan is not a substitute for normal property maintenance.
The Subscriber remains responsible for routine inspections, servicing, cleaning, preventative maintenance, replacement of consumable items, ordinary repairs, and maintaining the property in a reasonably safe and serviceable condition.
Failure to reasonably maintain the property may be considered when assessing a claim.
________________________________________
28. CHANGE OF PROPERTY USE
The Subscriber must notify the Provider of any material change to the use of the Covered Property.
This includes changing the property from residential to commercial use, residential to office use, residential to short-term accommodation, occupied to vacant, or any other use that may affect eligibility.
The Provider may review continued eligibility following such a change.
________________________________________
29. TRANSFER OF PLAN
The Plan is personal to the Subscriber and registered Covered Property unless the Provider expressly agrees otherwise in writing.
The Plan cannot be transferred to another property without the Provider's approval.
The Plan cannot be transferred to another person automatically.
Any proposed transfer must be approved by the Provider.
________________________________________
30. TERMINATION
30.1 Termination by Either Party
Either the Subscriber or the Provider may terminate the Plan at any time by providing notice to the other party in accordance with the applicable subscription terms.
30.2 No Refund
All Subscription Fees and other amounts paid in advance are non-refundable upon termination, regardless of the reason for termination, including voluntary termination by the Subscriber or termination by the Provider, except approved by Provider.
Termination shall not entitle the Subscriber to receive a refund of any prepaid Subscription Fee, payment for any unused portion of the subscription period, payment for any unused claim entitlement, payment for any unused Service Limit, or any cash equivalent of the remaining subscription benefits.
30.3 Termination by Provider
The Provider may terminate or suspend the Plan where the Subscriber provides materially false, inaccurate or misleading information, the Subscriber commits or attempts to commit fraud, the Subscriber abuses or misuses the Plan, the Covered Property becomes ineligible, the Subscriber ceases to be a legal or registered owner or co-owner of the Covered Property, the required Subscription Fees are not paid, the Subscriber materially breaches this Policy, the Subscriber fails to provide information or access reasonably required to administer the Plan, or termination or suspension is otherwise permitted under applicable law.
30.4 Effect of Termination
Upon termination, the Subscriber's entitlement to make new claims shall cease from the effective date of termination, the Provider shall have no obligation to provide services for incidents occurring after termination, any unused claim entitlement shall immediately lapse, any unused portion of the Service Limit shall immediately lapse, any prepaid Subscription Fee shall remain non-refundable, subject to applicable law, and any obligation or liability that arose before the effective date of termination shall survive termination.
30.5 Existing Approved Repairs
Where a claim has already been approved before termination, the Provider may, at its discretion and subject to applicable law, determine whether the approved repair will proceed.
Termination shall not automatically create an obligation for the Provider to complete an approved repair where the Subscriber has materially breached this Policy, provided false or misleading information, committed fraud, or where completion of the repair is otherwise prohibited or impracticable.
30.6 No Waiver
Termination of the Plan shall not constitute a waiver of any rights, remedies, claims or liabilities accrued by either party before the effective date of termination.
________________________________________
31. NO GUARANTEE OF REPAIR
The Plan does not guarantee that every property problem will be repaired.
All services remain subject to property eligibility, Subscriber eligibility, the 90-day Waiting Period, claim frequency limitations, inspection, claim assessment, exclusions, the Service Limit, availability of suitable contractors and specialists, technical feasibility, and the Provider's determination under this Policy.
________________________________________
32. FORCE MAJEURE
The Provider shall not be responsible for delay or inability to provide services caused by circumstances beyond its reasonable control.
Such circumstances may include natural disasters, floods, fires, severe weather, government restrictions, shortage of materials, shortage of specialist personnel, transportation disruption, supply-chain disruption, industrial action, equipment failure beyond reasonable control, or other circumstances beyond the Provider's reasonable control.
________________________________________
33. LIMITATION OF LIABILITY
To the extent permitted by applicable law, the Provider's total aggregate monetary liability arising out of or relating to the Plan, whether in contract, tort (including negligence), breach of statutory duty or otherwise, shall not exceed the Subscription Fee actually paid by the Subscriber for the subscription period to which the claim relates.
This monetary liability cap does not change the Service Limit applicable to approved repair services under Section 11.
The Provider shall not be responsible for indirect, consequential or incidental losses arising from delay, inability to use the property, loss of income, loss of rental, loss of business, inconvenience, temporary accommodation, loss of opportunity, or other consequential losses, except where such limitation is prohibited by applicable law.
Nothing in this Policy is intended to exclude or limit any liability that cannot lawfully be excluded or limited.
________________________________________
34. POLICY INTERPRETATION
This Policy shall be read together with the subscription confirmation, quotation, invoice, service order, Completion Sign-Off, applicable service terms, and any written agreement issued by the Provider.
Where there is an inconsistency, the Provider shall determine the applicable terms subject to applicable law.
Nothing in this Policy is intended to exclude any mandatory rights or protections available to the Subscriber under applicable law.
________________________________________
35. AMENDMENT OF POLICY
The Provider may amend the terms of the Plan from time to time.
Any amendment affecting an existing Subscriber shall be handled in accordance with the applicable subscription terms and applicable law.
The version of the Policy applicable to a particular claim shall be determined based on the Subscriber's applicable subscription terms and effective dates.
________________________________________
36. GOVERNING LAW
This Policy shall be governed by and interpreted in accordance with the laws of Malaysia, unless otherwise expressly agreed in writing and permitted by applicable law.
Any dispute arising from or relating to the Plan shall be dealt with in accordance with the applicable laws and dispute-resolution procedures of Malaysia.
________________________________________
37. IMPORTANT NOTICE
The Property Repair Protection Plan is a subscription-based property repair service arrangement.
It provides access to qualifying repair services subject to the terms, conditions, limitations and exclusions contained in this Policy.
Unless the Provider is duly licensed or otherwise legally authorized to provide insurance, the Plan should not be represented as an insurance policy, an insurance contract, an insurance product, a guarantee of payment, or any other regulated financial product.
The Provider recommends that Subscribers carefully read this Policy before subscribing.
________________________________________
SCHEDULE 1 — PLAN SUMMARY
Only a registered property owner or co-owner can subscribe, and the Subscriber must be one of the legal or registered owners. The Plan applies to an eligible occupied residential property, subject to a 90 calendar day waiting period and a maximum of one Claimable Event every 12 months. Coverage is limited to approved repair cost only, with inspection cost excluded and payable by the Subscriber, and the maximum service value is 10 times the Subscription Fee. The main scope covers critical incidents requiring specialist expertise and/or heavy machinery, while routine wear and tear, day-to-day repairs, properties under construction, non-residential properties (unless expressly accepted), vacant properties, pre-existing conditions, upgrades, and improvements are excluded. Cash settlement is not normally available, and independent repair requires prior approval. The repair schedule is mutually agreed where practicable, although the Provider has the final determination of the schedule, claim determination, and approved Repair Cost, subject to applicable law. The Subscriber is responsible for any amount above the Service Limit. The post-repair warranty lasts 7 calendar days from the date of the Completion Sign-Off and applies only to the original approved repair workmanship or repair failure.
________________________________________
SCHEDULE 2 — CLAIM EXAMPLE
Example 1 — Approved Repair Within Limit
In this example, the Subscription Fee is RM500, resulting in a Service Limit of RM500 × 10 = RM5,000. The Approved Repair Cost is RM30,000, so the maximum service provided is RM30,000. The approved repair is within the Service Limit.
________________________________________
Example 2 — Repair Exceeds Service Limit
In this example, the Subscription Fee is RM500, giving a Service Limit of RM50,000. The Approved Repair Cost is RM80,000, so the maximum Plan service value remains RM50,000, leaving a balance of RM30,000. If the Subscriber elects to proceed, the Subscriber is responsible for the RM30,000 excess.
________________________________________
Example 3 — Inspection
In this example, the Inspection Cost is RM500 and the Approved Repair Cost is RM30,000. The Subscriber remains responsible for the RM500 inspection cost, and the approved repair service may be provided subject to the Plan.
________________________________________
Example 4 — Seven-Day Warranty
In this example, the Repair Completion Sign-Off is dated 1 January, giving a Warranty Period from 1 January to 7 January. If a defect directly relating to the completed repair is reported within the applicable seven-day warranty period and the Provider determines that it resulted from the repair work, the Provider may arrange rectification under the post-repair warranty. A new unrelated defect discovered during the same period is not automatically covered.
________________________________________
